Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and RoadWhispr (“we,” “us,” or “our”) governing your use of the RoadWhispr mobile application and any related services (collectively, the “Service”). By accessing or using the Service, you affirm that you are at least 13 years of age, and that you accept and agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein.

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

Subject to your compliance with these Terms, RoadWhispr grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial purposes.

You may not: (a) copy, modify, or distribute the App; (b) reverse engineer, decompile, or disassemble the App; (c) sublicense, sell, or transfer the App or your access rights; (d) use the App for any unlawful purpose; or (e) remove any proprietary notices from the App.

This license does not include any right to use our intellectual property, trademarks, or trade names except as explicitly permitted in these Terms.

Certain features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately at support@roadwhispr.com of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

RoadWhispr may offer both free and premium subscription tiers. Premium features are available through a paid subscription or one-time in-app purchases, all processed through Apple's in-app purchase system.

Subscriptions automatically renew at the end of each subscription period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID account settings.

Refundsare handled by Apple in accordance with Apple's refund policies. RoadWhispr has no ability to issue refunds directly. All prices are subject to change with notice.

Free trials: If we offer a free trial, any unused portion will be forfeited when you purchase a subscription. Promotional pricing is valid only during the stated promotional period.

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Engage in any conduct that restricts or inhibits any other user from using the Service
• Use the Service while driving in a manner that compromises road safety
• Attempt to gain unauthorized access to any part of the Service or its systems
• Transmit any advertising or promotional material without our prior written consent
• Impersonate any person or entity or misrepresent your affiliation with a person or entity
• Collect or harvest any personally identifiable information from the Service
• Interfere with or disrupt the integrity or performance of the Service

The Service and its original content, features, and functionality — including all audio stories, narrations, scripts, software, design elements, trademarks, and logos — are and will remain the exclusive property of RoadWhispr and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent.

The stories and audio content available through the App are licensed, not sold. You may not download, copy, redistribute, or use the content for any purpose other than personal listening within the App.

RoadWhispr requires access to your precise GPS location to function. By enabling location services, you acknowledge that the App will access your device's location data. Please ensure that your use of the App complies with all applicable traffic laws and safety regulations.

Drive safely. RoadWhispr is intended to be enjoyed hands-free. We strongly recommend connecting your device to a car audio system before driving. You are solely responsible for operating your vehicle safely in compliance with applicable laws.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

We do not warrant the accuracy, completeness, or usefulness of any information or content available through the Service. The stories and historical narratives in the App are for entertainment purposes and may include dramatized or speculative content. They should not be relied upon as authoritative historical or factual accounts.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROADWHISPR, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
